General Terms and Conditions (GTC) of Bidcars AG

1. General
Bidcars AG, based in Switzerland, operates a B2B online car auction platform under the domain www.bidcars.ch. Registered users can offer vehicles for auction and bid on offers through the platform.
These GTC govern the legal relationships between Bidcars AG and users in connection with the use of the platform and the associated services.
By registering and using the platform, users fully accept these GTC.
2. Role of Bidcars AG
Bidcars AG merely provides the technical infrastructure for processing online auctions. Bidcars AG is not a contracting party to the purchase contracts concluded via the platform. These are exclusively concluded between the seller (consignor) and the buyer (bidder).
Bidcars AG acts as an intermediary platform, but does not act as a representative or broker. It does not intervene in contract negotiations and assumes no responsibility for the content or fulfillment of purchase contracts between users.
Bidcars AG generates its revenue exclusively through the fees charged on the platform. Currently, however, there are no fees as the platform is currently free of charge.
3. Registration and User Obligations
The use of the platform is only permitted to registered users. By registering, the user confirms that they are of legal age, capable of acting, and in possession of all commercial permits required for participation.
Bidcars AG reserves the right to reject registrations without giving reasons or to block user accounts in case of violations.
Users are obliged to keep their information correct and up to date at all times. Changes (e.g., address, company data, contact person) must be communicated to Bidcars AG immediately.
4. Auction Process
The auctions on www.bidcars.ch are conducted digitally. The seller (consignor) lists a vehicle with a binding offer, possibly with a minimum price.
A purchase contract between the seller and the highest bidder is concluded:
• when the minimum price is reached or exceeded,
• or when the seller accepts the highest bid even below the minimum price.
Submitted bids are binding and cannot be withdrawn.
5. Payment Terms
After successful completion of an auction, the buyer is obligated to pay the full purchase price directly to the seller within 10 calendar days. Bidcars AG is neither involved in the payment process nor liable for missing payments.
6. Delivery
Unless otherwise agreed between buyer and seller, vehicle delivery takes place within 2 to 5 working days after payment, provided there are no public holidays in between. The transaction is carried out exclusively between the contracting parties.
If the buyer collects the vehicle on site, they can arrange an appointment with the seller after the auction closes to coordinate the collection individually.
7. Fees
The use of the platform is currently free of charge. The applicable fee schedule is available at www.bidcars.ch at any time and forms an integral part of these GTC. Should this change in the future, users will be informed in due time.
8. Liability and Warranty
Bidcars AG assumes no warranty or liability for:
• the condition or accuracy of information about vehicles,
• legal or technical freedom from defects,
• receipt of payment or contract fulfillment by users.
Complaints can be reported to Bidcars AG. These will be reviewed, but do not lead to a liability obligation for Bidcars AG.
In case of violations of the GTC, Bidcars AG reserves the right to block or permanently deactivate user accounts.
9. Exclusion of Liability
Since Bidcars AG is not a contracting party, it excludes any liability for legal disputes, damages, or claims resulting from contracts concluded between users.
The platform serves exclusively as an intermediary. Use is at your own risk.
10. Data Protection
The processing of personal data is carried out in accordance with applicable data protection regulations. The complete privacy policy is available at www.bidcars.ch/privacy and forms an integral part of these GTC.
11. Jurisdiction and Applicable Law
Swiss law applies exclusively to all disputes between a user and Bidcars AG.
The place of jurisdiction is the registered office of Bidcars AG.
12. Severability Clause
Should individual provisions of these GTC be invalid or void, the validity of the remaining provisions shall remain unaffected. Instead of the invalid regulation, a legally valid regulation shall apply that comes as close as possible to the economic purpose of the original.
